1. Basic Terms

Please read these Terms of Service (the ‘Terms’) carefully before using The Cultural Me and all services provided by The Cultural Me T/N Recreyo Limited, collectively known as the ‘Service’.

‘The Cultural Me’ is a trademark of The Cultural Me T/N Recreyo Limited. All rights reserved.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Service.

If you register with or use the Service, we will ask you to expressly agree to these Terms.

You must be at least 18 years of age to use the Service; by using the Service or agreeing to these Terms, you warrant and represent to us that you are at least 18 years of age.

Our Service uses cookies; by using the Service or agreeing to the Terms, you consent to our use of cookies in accordance with the terms of our privacy policy and our cookies policy.

2. Content you provide

By submitting content to the Service, this includes images, descriptions, posts, comments, ratings, lists, and map locations, (collectively ‘Submissions’), you grant The Cultural Me a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sub-licensable right to:

• Use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Submissions throughout the world in any media, now known or hereafter devised, for any purpose; and
• Use the name that you submit in connection with such Submission. You acknowledge that The Cultural Me may choose to provide attribution of your comments or posts at our discretion. You further grant The Cultural Me the right to pursue at law any person or entity that violates your or The Cultural Me’s rights in the Submissions by a breach of this Agreement. You acknowledge and agree that Submissions are non-confidential and non-proprietary.

3. Prohibited Activities

The following activities are prohibited:

• You will not provide any false personal information on The Cultural Me, or create an account for anyone other than yourself without permission.
• You will not create more than one personal account.
• If we disable your account, you will not create another one without our permission.
• You will keep your contact information accurate and up-to-date.
• You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.
• You will not post unauthorized commercial communications (such as spam) on The Cultural Me.
• You will not collect users’ content or information, or otherwise access The Cultural Me, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission.
• You will not upload viruses or other malicious code.
• You will not solicit login information or access an account belonging to someone else.
• You will not bully, intimidate, or harass any user.
• You will not post content that: is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.
• You will not use The Cultural Me to do anything unlawful, misleading, malicious, or discriminatory.
• You will not do anything that could disable, overburden, or impair the proper working or appearance of The Cultural Me, such as a denial of service attack or interference with page rendering or other The Cultural Me functionality.
• You will not facilitate or encourage any violations of the Terms or our policies.
• You will not post content or take any action on The Cultural Me that infringes or violates someone else’s rights or otherwise violates the law.
• We can remove any content or information you post on The Cultural Me if we believe that it violates the Terms or our policies.
• If we remove your content for infringing someone else’s copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.
• If you repeatedly infringe other people’s intellectual property rights, we will disable your account when appropriate.
• You will not use our copyrights or Trademarks or any confusingly similar marks, except with our prior written permission.

4. Copyright Policy

The Cultural Me respects the intellectual property rights of others and expects users of the Service to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your Content has been copied in a way that constitutes copyright infringement, please provide us with the following information:

• a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
• identification of the copyrighted work claimed to have been infringed;
• identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
• your contact information, including your address, telephone number, and an email address;
• a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
• a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

We reserve the right to remove Content alleged to be infringing without prior notice, at our sole discretion, and without liability to you.

In appropriate circumstances, The Cultural Me will also terminate a user’s account if the user is determined to be a repeat infringer.

5. Amendments

We’ll notify you before we make changes to these Terms and give you the opportunity to review and comment on the revised Terms before continuing to use the Service.

If we make changes to policies, guidelines or other terms referenced in or incorporated by these Terms, we may provide notice by email.

Your continued use of the Service, following notice of the changes to our terms, policies or guidelines, constitutes your acceptance of our amended terms, policies or guidelines.

6. No warranties

The Service is provided ‘as is’ without any representations or warranties, express or implied.The Cultural Me makes no representations or warranties in relation to the Service or the information and materials provided by the Service. Without prejudice to the generality of the foregoing paragraph, The Cultural Me does not warrant that:

• the Service will be constantly available, or available at all; or
• the information provided by the Service is complete, true, accurate or non-misleading.

Nothing provided by the Service constitutes, or is meant to constitute, advice of any kind.

7. Limitations of liability

The Cultural Me will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, the Service:

• to the extent that the Service is provided free-of-charge, for any direct loss
• for any indirect, special or consequential loss; or
• for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

8. Links to other web sites

The Service may contain links to thirdparty web sites or services that are not owned or controlled by The Cultural Me.

The Cultural Me has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that The Cultural Me shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any thirdparty web sites or services that you visit.

9. Exceptions

Nothing in the Terms will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in the Terms will exclude or limit The Cultural Me’s liability in respect of any:

• death or personal injury caused by The Cultural Me’s negligence;
• fraud or fraudulent misrepresentation on the part of The Cultural Me; or
• matter which it would be illegal or unlawful for The Cultural Me to exclude or limit, or to attempt or purport to exclude or limit, its liability.

10. Reasonableness

By using the Service, you agree that the exclusions and limitations of liability set out in the Terms are reasonable.

If you do not think they are reasonable, you must not use the Service.

11. Other parties

You accept that, as a limited liability entity, The Cultural Me has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against The Cultural Me’s officers or employees in respect of any losses you suffer in connection with the Service.

Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in the Terms will protect The Cultural Me’s officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as The Cultural Me.

12. Unenforceable provisions

If any provision of the Terms is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of the Terms.

13. Indemnity

You hereby indemnify The Cultural Me and undertake to keep The Cultural Me indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by The Cultural Me to a third party in settlement of a claim or dispute on the advice of The Cultural Me’s legal advisers) incurred or suffered by The Cultural Me arising out of any breach by you of any provision of the Terms, or arising out of any claim that you have breached any provision of the Terms.

14. Jurisdiction and Governing Law

Each of the parties to this Agreement irrevocably agrees that the courts of England shall have exclusive jurisdiction to hear and decide any suit, action or proceedings, and/or to settle any disputes, which may arise out of or in connection with the Terms or its formation or validity and, for these purposes, each party irrevocably submits to the jurisdiction of the courts of England.

15. Termination

These Terms will continue to apply until terminated by either you or The Cultural Me as follows:

You may end your legal agreement with The Cultural Me at any time for any or no reason by emailing sara@theCultural.me and discontinuing your use of the Service.

We may suspend or terminate your accounts at any time for any or no reason, including, but not limited to, if we reasonably believe:

• you have violated the Terms
• you create risk or possible legal exposure for us; or
• our provision of the Service to you is no longer commercially viable. We will make reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account.

In all such cases, these Terms shall terminate, including, without limitation, your license to use the Service, except that the following sections shall continue to apply: 2, 3, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14 and 15.
